Lawyers and Zombies

Joe Barrett host of Trigger Time Sunday nights on 55KRC posted a very interesting observation on Facebook. He warns against carrying Hornady's Zombie Max ammo because it could be used against you in a court of law.

I had a listener tell me he carried this ammo in his self defense guns, but heard someone say perhaps he shouldn't due to the "Disclaimer" from Hornady. Having read it, I have to say I wouldn't own it either. It doesn't matter if it really isn't any more effective than something else, THIS ONE comes with the instructions by the manufacturer that it should never be used against a human being, and I am guessing an attorney could make good use of that in a civil trial if nothing else. I hope Greg, David, Bill and/or some of the more experienced trainers will give their two cents on this topic.

    1. Because a PROSECUTOR could bullshit ignorant JURORS about it AT TRIAL. And if you go to PRISON you are STILL IN PRISON even if you are laughing at the dumb jurors the whole time. Maybe you think it's fine to be in prison as long as you feel superior to some dumb juror, but if so, YOU are DUMBER than the JURORS.

  2. I think this disclaimer might be a case of Poe's Law. Then again, I would not want to put that determination in the hands of a jury, why take the chance.

    Paper targets are made from dead trees. According to the disclaimer plants shouldn't be shot with the ammo. Ergo, you can't even shoot at paper targets without the possibility of being sued. You can't even practice hitting zombie targets.

    Why bother having the stuff (except, of course, in the actual event of a zombie attack)

  4. I only load Law Enforcement shotgun OO buckshot. It would be hard for a pond-scum prosecuting attorney to claim that I was using EVIL ammunition if police use it.

I agree, but just to play devil's advocate for moment, they could try to claim that you were a cop wannabe looking for a fight, and that there is no place in our society for this kind of vigilante madness. Its a stretch, but we have already assumed a fairly manipulable jury and unscrupulous prosecutor going into this.

  5. The answer to "wannabe cop" is just a simple: if it is good enough for the police to defend citizens/my family/me with it is good enough for me to defend myself/my family.
